Terms and Conditions

The following terms and conditions apply to any courses delivered by Driver Training Waikato (DTW) and its website www.trucklicence.co.nz.

Acceptance of Terms and Conditions

By using the DTW website www.trucklicence.co.nz, registering for a course (whether paid, via direct credit, or on account), submitting online forms, or engaging DTW for services, you agree to these terms and conditions.

The following expressions and meanings apply to these Terms and Conditions:

  • 'Service' or 'Services' refers to any service provided by DTW, including training courses.

  • 'We', 'Us', and 'Our' refer to DTW.

  • 'You' and 'Your' refer to users and/or visitors of the DTW website.

  • 'Website' refers to the DTW website at www.trucklicence.co.nz.

  • 'Product' refers to any product, training service, or course available for registration, sale, and/or purchase through DTW.

  • 'Customer' or 'Customers' include any individual who purchases or registers for a service via the DTW website.

Changes to Terms and Conditions

The terms and conditions are subject to change periodically. Any modifications will become effective immediately upon their publication on the website. DTW customers have the responsibility to stay updated with the most recent terms and conditions. Continued use of the DTW website constitutes acceptance of these terms and conditions.

Insurance and Indemnity

The client bears all insurance-related risks concerning all vehicles, equipment, and loads they provide for use by their drivers/operators and our instructors during training sessions.

Unless we have explicitly accepted responsibility for you under these Terms, you agree to indemnify us against any legal actions and cover any costs, losses, or expenses we incur due to your use of our website or any breach of these terms.

Service Guarantees

The training services provided by DTW are protected under the Consumer Guarantees Act.  DTW ensures they are fit for purpose and delivered with reasonable care, skill, and responsibility. Your rights regarding service provision and supply are safeguarded by legislation. For further details, The Office of the Privacy Commissioner can offer more information.

Your Information

As a user of the DTW website, you guarantee that you have provided complete, accurate, and up-to-date personal or business information. DTW may contact you by phone or email to verify these details. You agree not to allow any other person to use your details or customer information to purchase services through the DTW website, without limiting any other rights or remedies we may have.

Course Schedule

The course schedule listed on the website may change without prior notification. Course details are revised as new information becomes available, including space availability. Although every attempt is made to avoid errors, they can occasionally occur. Should there be any inaccuracies on the website, registrants will be notified and provided with alternative options.

Course Fees

Course fees are typically quoted verbally or in writing before course registration and can also be found on our website. Registering for or attending a course signifies the client's acceptance of the fees.

All prices listed on the website are in New Zealand dollars and are subject to change without prior notice. The prices quoted include GST (Goods and Services Tax).

Courier fees do not apply to course materials unless specified otherwise.

Confirmation of Order/Course Registration/Payment Terms

The course fee must be paid in full at the time of booking. Please provide at least three working days' notice for cancellation of a booking. Registration for the course is not confirmed until payment is received, and any prerequisites are met and verified.

Client Cancellation/Withdrawal/Refund Policy

DTW requires a written notice of cancellation three working days in advance. 

DTW Services Course Cancellation/Abandonment

Practical training may be cancelled or abandoned due to unsafe or illegal conditions. The DTW Training instructor will, where possible, consult with the nominated client representative before making any decisions.

Cancellation may also occur due to trainer availability issues, such as sickness or bereavement. We strive to provide at least 48 hours notice, but occasionally, it may be as short as 24 hours.

Should this happen, we will schedule an alternative time and date. If you are unable to attend, and provided all course materials are returned in their original condition, a full refund for the course will be issued.

Attendance

When a start time is specified for a training course, it represents the exact time the course begins. The times are set to guarantee that the necessary learning can be completed within the allotted duration. DTW reserves the right to deny access to any participant who attempts to join a course in progress, and the standard cancellation policy will be enforced (refer to the cancellation policy detailed above).

Confidentiality/Intellectual Property/Copyright

The information or quotes provided by DTW services are commercially sensitive and must not be disclosed to third parties.

The intellectual property rights of the courses and their materials are protected by copyright laws and cannot be copied without explicit written consent.

The content displayed on the DTW website (www.trucklicence.co.nz) is the property of DTW unless stated otherwise. Reproduction in any form or medium for commercial, non-commercial, or informational purposes is prohibited without DTW's prior written permission. This is contingent upon the content being replicated accurately and not in a deceptive manner. When republishing or copying any copyrighted material from this site, the source must be cited, and the copyright status acknowledged. The right to reproduce copyrighted material does not include any content on this site that is the property of a third party. Permission to use such material must be obtained from the respective copyright owners. Health and Safety

DTW maintains a formal Health and Safety Policy and Plan that is mandatory for all instructors to follow.

General Terms

In the event of a dispute related to these Terms and Conditions, the New Zealand courts will not have exclusive jurisdiction over such a dispute. Not exercising or enforcing any right under these Terms does not constitute a waiver of those rights by us. We may assign this agreement or any rights or obligations under it to another party without notice to you. You cannot assign any rights or obligations to another person without our written consent. Each clause of these Terms is binding independently; if any part is unenforceable, the remaining parts will continue to be in effect.

We strive to ensure the information on this website is as accurate as possible according to DTW's knowledge. However, nothing on this site should be taken as professional advice of any kind. For legal, financial, or medical advice, please consult a qualified professional.

DTW does not guarantee the accuracy or completeness of the information on this website, nor its suitability for any particular purpose. Privacy Act 2020

As an individual, you possess rights under the Privacy Act 2020 to access and request corrections to your personal information held by us. Regarding your personal information, you:

  • Authorize us to acquire personal information about you through your Registration Form and your use of DTW and our services.

  • Authorize us to utilize your personal information for direct marketing, promotional activities, research and development, identity verification, and other related aspects of providing our services to you.

  • Agree that additional notification about the purpose of collecting your personal information is not required and that non-compliance with Principle 3 of the Privacy Act 1993 is permissible.

Linking to the Website

We welcome contextual links to our website and conduct regular reviews. Sharing information on social media sites is also encouraged. However, any content linked remains subject to the specified terms and conditions.
